1. Introduction
1.1 Purpose
1.1.1 These Terms of Service ("Terms") govern your access to and use of Unisoul Health Pvt. Ltd.'s website, mobile apps, vendor portals, and related services ("Platform").
1.2 Agreement
1.2.1 By registering, booking, or using our Platform, you agree to be legally bound by these Terms.
1.2.2 If you do not agree, you should not access or use the Platform.
1.3 Applicability
1.3.1 These Terms apply to:
- Customers booking or using services.
- Vendors and service providers offering services.
- Administrative and support staff engaged with the Platform.
1.3.2 These Terms are updated periodically. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
2. Definitions
2.1 Customer
2.1.1 Definition
An individual who uses the Platform to browse, book, pay for, or receive services.
2.1.2 Eligibility
Customers must be 18 years or older. Minors may participate only with parent/legal guardian consent and supervision where required.
2.1.3 Permitted Use
Create an account, view services, make appointments, make payments, give feedback/reviews, and contact support.
2.1.4 Responsibilities
Provide true and complete details, keep login credentials confidential, follow pre-care/post-care instructions, and disclose relevant medical history for medical/chemical/laser services.
2.1.5 Prohibited Use
No fake bookings, misuse of offers, abusive behavior, unlawful activity, account sharing, or infringement of others' rights.
2.1.6 Relationship
The Customer receives services via the Platform. For vendor-delivered services, Unisoul Health acts as a facilitator; the vendor remains responsible for service execution.
2.1.7 Account
Customer accounts are personal and non-transferable. The Customer is responsible for all activity under their account.
2.2 Vendor / Service Provider
2.2.1 Definition
An individual or entity registered on the Platform to provide services to Customers.
2.2.2 Types of Vendors
(a) Medical Vendors (e.g., physiotherapists, dermatologists, BAMS doctors) for licensed services.
(b) Non-Medical Vendors (e.g., yoga trainers, fitness coaches, beauty/spa therapists).
2.2.3 Licensing & Credentials
Medical Vendors must hold valid licenses/certifications and comply with applicable regulations. Non-Medical Vendors must have suitable training/experience proofs. All documents must be current and verifiable.
2.2.4 Status
Vendors are independent contractors, not employees or agents of Unisoul Health.
2.2.5 Obligations
Deliver services with due skill and care, follow safety and hygiene standards, maintain records as required, protect customer data, honor bookings/cancellations per policy, and comply with all laws.
2.2.6 Payments & Taxes
Vendors are responsible for their tax compliance and invoices where applicable. Platform fees/commissions (if any) may be deducted as per the vendor agreement.
2.2.7 Prohibited Conduct
No misrepresentation of qualifications, unsafe practices, unlawful advertising/claims, or IP infringement.
2.2.8 Verification & Audits
Unisoul Health may verify documents, conduct quality checks, and suspend/terminate vendor access for non-compliance or poor quality.
2.3 AI-Powered Health Assistant
2.3.1 Definition & Purpose
An automated tool within the Platform that gives general wellness tips (e.g., body pain, skincare, stress) for informational purposes.
2.3.2 Scope
Provides lifestyle suggestions, self-care routines, and basic educational content.
2.3.3 Exclusions
No medical diagnosis, prescriptions, or emergency advice. Not a substitute for consultation with a licensed professional.
2.3.4 User Responsibility
Users must not rely on AI outputs for medical decisions and should seek professional advice for symptoms, conditions, or emergencies.
2.3.5 Liability
Use of the AI Assistant is at the user's discretion. Unisoul Health is not liable for decisions made solely based on AI guidance.
2.4 Personal Data
2.4.1 Definition
Any information that can identify an individual (alone or with other data) processed in line with applicable Indian law, including the Digital Personal Data Protection Act, 2023.
2.4.2 Categories
(a) Account Data: name, age, gender, contact details.
(b) Health/Sensitive Data (for medical services): medical history, prescriptions, allergies, treatment notes.
(c) Transactional Data: bookings, payments, invoices.
(d) Technical Data: device, IP, app usage, cookies (as per Privacy Policy).
(e) Communications: support chats, emails, feedback/reviews.
2.4.3 Purposes of Use
To provide and manage services/bookings, ensure safety of treatments, process payments, send confirmations/alerts, improve quality, comply with law, and—only with consent—send offers/wellness tips.
2.4.4 Sharing
Shared only as needed with vendors providing the booked service, payment gateways, communication providers, or regulators as required by law. No sale of personal data.
2.4.5 Retention & Deletion
Medical records are typically retained 3–5 years (or as required by law). Other data is kept for the period necessary for operations/legal obligations and then securely deleted or anonymized.
2.4.6 Security
Stored with appropriate technical and organizational safeguards (encryption, access controls).
2.4.7 User Rights
Access, correction, withdrawal of consent (where applicable), data portability where feasible, and deletion subject to legal/medical record requirements.
2.4.8 Grievance
Users may contact the designated Grievance Officer for data queries or complaints (details in the Grievance section).
3. Scope of Services
Unisoul Health Pvt. Ltd. provides both Medical Services (requiring licensed professionals and compliance with healthcare regulations) and Non-Medical Services (wellness, fitness, or cosmetic services). Each service category is described below:
3.1 Physiotherapy & Pain Management
3.1.1 Medical
3.1.1.1 Provided only by licensed physiotherapists.
3.1.1.2 Covers injury rehabilitation, post-surgical recovery, chronic pain management, neurological or orthopedic physiotherapy, and mobility enhancement.
3.1.1.3 Requires disclosure of medical history, prescriptions, or doctor's referral where applicable.
3.1.1.4 Services are designed to complement physician care and not to replace hospital treatment.
3.1.2 Non-Medical
3.1.2.1 Includes stretching, posture correction, flexibility training, and preventive exercise sessions.
3.1.2.2 Conducted by certified trainers, not medical doctors.
3.1.2.3 Intended for general wellness, not medical diagnosis or treatment.
3.2 Yoga & Meditation
3.2.1 Medical
3.2.1.1 Conducted by certified yoga therapists in collaboration with healthcare professionals.
3.2.1.2 Recommended for individuals with chronic conditions such as stress disorders, respiratory issues, or chronic pain.
3.2.1.3 May require medical clearance for patients with serious or pre-existing health conditions.
3.2.2 Non-Medical
3.2.2.1 Includes yoga postures, breathing exercises (pranayama), mindfulness, and meditation classes.
3.2.2.2 Conducted by certified yoga instructors for relaxation, lifestyle improvement, and stress management.
3.2.2.3 These sessions do not provide medical treatment.
3.3 Health Club & Fitness
3.3.1 Medical
3.3.1.1 Fitness or rehabilitation programs designed or supervised by a doctor or physiotherapist.
3.3.1.2 Includes weight-loss programs for medical reasons, post-injury strengthening, or cardiac rehabilitation.
3.3.1.3 Requires appropriate medical history and clearance before participation.
3.3.2 Non-Medical
3.3.2.1 Includes gym workouts, group exercise classes, aerobics, strength training, and personal training.
3.3.2.2 Conducted by certified fitness trainers, not doctors.
3.3.2.3 Focused on fitness and body toning, not on medical recovery.
3.4 Ayurvedic Treatments
3.4.1 Medical
3.4.1.1 Prescribed by certified Ayurvedic doctors (BAMS or equivalent).
3.4.1.2 Includes Panchakarma therapies, detoxification programs, and herbal medicinal treatments.
3.4.1.3 Targeted for conditions like arthritis, digestive imbalance, or chronic skin disorders.
3.4.2 Non-Medical
3.4.2.1 Includes relaxation massages, herbal body therapies, rejuvenation packages, and spa-style treatments.
3.4.2.2 Conducted by trained Ayurvedic therapists under non-clinical settings.
3.4.2.3 Intended for lifestyle balance and relaxation, not medical diagnosis.
3.5 Beauty & Skincare
3.5.1 Medical
3.5.1.1 Dermatologist or cosmetologist-supervised procedures.
3.5.1.2 Includes laser treatments, chemical peels, acne treatments, and advanced skin-lightening or resurfacing procedures.
3.5.1.3 Requires prior disclosure of allergies and informed consent.
3.5.2 Non-Medical
3.5.2.1 Includes facials, hair spa, skin rejuvenation, body scrubs, and cosmetic relaxation therapies.
3.5.2.2 Conducted by trained beauty and wellness professionals.
3.5.2.3 Focused on aesthetic enhancement, not medical care.
3.6 Exclusions
3.6.1 Unisoul Health does not provide emergency hospital care, surgeries, or prescription-based treatments (except where a licensed doctor is directly involved).
3.6.2 Customers must seek emergency medical attention for life-threatening conditions (e.g., heart attack, severe injury, difficulty breathing).
3.6.3 Non-Medical services are wellness-focused and do not replace professional medical consultation.
